Bankruptcy Court revises Chapter 13 plan model form

The Bankruptcy Court for the Southern District of Indiana as of August 15, 2013, requires use of a revised Chapter 13 plan model form, pursuant to Local Rule B-3015-1. The form is available on the court’s website and may be used immediately.

New Change for Chapter 13 Plan in Southern Indiana

As of August 15, 2013, a change in the standard language in the Southern Indiana Chapter 13 plan was implemented addressing the “Surrender” provision. The new plan now provides that as to any surrendered real estate the stay is terminated upon confirmation.  David C. Nalley, Esq., of Reisenfeld & Associates, had asked the Clerk to submit a request for this change to the Judges and Trustees, and they agreed to include it in the plan.
